Terms and Conditions

Article 1. Applicability

1.1 These general sales conditions (hereinafter conditions) apply to all offers, orders, and agreements of Hops & Hopes, to the exclusion of any other general terms and conditions.

1.2 All rights and claims, as stated in these terms and conditions and in any further agreements for the benefit of Hops & Hopes, are also stipulated for the benefit of intermediaries and other parties engaged by Hops & Hopes.

1.3 The statements in the terms and conditions can only be deviated from in writing, in which case the other stipulations will remain in full force and effect.

1.4 Placing an order means that you unconditionally accept the applicability of these terms and conditions.

Article 2. Agreement and offers

2.1 All offers from Hops & Hopes are without obligation, and Hops & Hopes reserves the right to change prices at any time. In particular when it is necessary because of (legal) regulations, or in the case of misprints and/or publication mistakes.

2.2 An agreement is only concluded after acceptance of your order by Hops & Hopes. Hops & Hopes is entitled to refuse orders or to deliver on certain conditions unless stated otherwise. Hops & Hopes will not accept orders placed by persons under eighteen years of age.

Article 3. Delivery

3.1 The delivery times stated by Hops & Hopes are indicative. Exceeding any delivery period does not entitle any compensation, nor the right to cancel the order or dissolve the agreement. However, in case the exceeding of the delivery is as such that it can not reasonably be expected to maintain the agreement, order cancellation is allowed.

Article 4. Prices and payments

4.1 The prices stated for the products and services offered by Hops & Hopes are in euros and VAT included. They exclude from handling and shipping costs, any taxes, or other levies unless stated otherwise.

4.2 Payment via the Hops & Hopes webshop is made via Mollie.

4.3 If you are in default with any payment, Hops & Hopes is entitled to suspend or dissolve the agreement while retaining her rights.

Article 5. Ownership

5.1 The ownership of the delivered products only transfers if you have done everything which was stated in the agreement with Hops & Hopes. The product responsibility is already transferred to you at the time of shipment.

Article 6. Complaints and liability

6.1 You have the obligation to check whether the delivered items meet the description. If this is not the case, please inform us at info@hopsandhopes.nl as soon as possible (within five working days). If it is demonstrated that the products do not comply with the agreement, Hops & Hopes has the option to replace the items with new products or to refund the money stated on the invoice.

6.2 If you do not wish to purchase a product (for any reason), you have the right to return your order to Hops & Hopes within 14 days after delivery. Return shipments are only accepted when the original packaging and products are undamaged. The costs of the return are for your own account. When returning products, any payment agreements will automatically expire.

Article 7. Orders and communication

7.1 Hops & Hopes is not liable for delays or incomplete orders and/or miscommunication resulting from the use of the internet or any other means of communication between you and Hops & Hopes, or between Hops & Hopes and third parties. Exceptions are only made if there is evidence for intent or negligence on the side of Hops & Hopes.

Article 8. Force majeure

8.1 Without prejudice to its other rights, Hops & Hopes has the right (at its own discretion) to suspend the execution of your order when there is force majeure. In addition, Hops & Hopes is allowed to cancel the agreement without judicial intervention or being obliged for offering any form of compensation. Exceptions are only made when this is unacceptable according to the standards of reasonableness and fairness.

Article 9. Additional and different terms

9.1 If you provide Hops & Hopes with a specific address in writing, Hops & Hopes is entitled to ship your order to that address unless a written statement of another address is given at the checkout.

9.2 When Hops & Hopes has exceptionally deviated from these terms for any reason this does not affect its rights. The right for Hops & Hopes to demand strict compliance with these terms and conditions keeps applying at any time. You can never do any justice based on the fact that Hops & Hopes apply these terms and conditions flexibly.

9.3 Hops & Hopes is authorized to use third parties in the execution of your orders.

9.4 Hops & Hopes reserves the right to change these terms and conditions at any time.

Article 10. Dutch law and disputes

10.1 All rights, obligations, offers, orders, and agreements to which these terms and conditions apply are in line with Dutch law.

10.2 All disputes between parties will be submitted exclusively to the appropriate and competent court in the Netherlands.
